Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RentVise mobile application and related services (collectively, the "Service"). By using RentVise, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use RentVise. By using the Service, you represent that you meet this requirement.

3. Account Registration and Security

• You must create an account to use RentVise
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate, current, and complete information during registration
• You must keep your account information up to date
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Account Deletion

You may delete your account at any time through the app settings. Upon deletion:

• Your access to the Service will be terminated
• Your data will be deleted in accordance with our Privacy Policy
• This action is permanent and cannot be undone

5. Permitted Use

You may use RentVise for lawful property and rental management purposes, including:

• Managing property information and records
• Tracking tenants and lease agreements
• Creating and managing invoices and payments
• Recording expenses and generating financial reports
• Managing deposits and charges

6. Prohibited Activities

You agree not to:

• Use the Service for any illegal, fraudulent, or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service, other accounts, or systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the app (except where permitted by law)
• Use automated tools to access or scrape the Service
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Share your account credentials with others

7. Your Data and Content

• You retain all ownership rights to the data and content you create or upload
• You grant us a limited license to process, store, and display your data solely to provide and improve the Service
• You are responsible for maintaining backups of critical data
• You represent that you have the right to upload and share any content you submit
• You are solely responsible for the accuracy and legality of your data

8. Intellectual Property

The Service, including all software, designs, graphics, text, and other content (excluding your user data), is owned by RentVise and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Service Availability and Updates

• We strive to keep the Service available 24/7, but cannot guarantee uninterrupted access
• We may perform scheduled or emergency maintenance that temporarily limits access
• We may update, modify, or discontinue features at any time with or without notice
• We may release updates that require you to accept new terms or upgrade your app

10. Third-Party Services

The Service may integrate with third-party services (e.g., Google Sign-In, Apple Sign-In, payment processors). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Fees and Payment

Some features of RentVise may require payment of fees. If applicable:

• You agree to pay all fees as described in the app
• Fees are non-refundable except as required by law
• We may change fees with advance notice
• You are responsible for any taxes associated with your use

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the Service will be error-free, secure, or uninterrupted
• We are not responsible for the accuracy, reliability, or legality of your data
• RentVise is a management tool and does not provide legal, financial, or tax advice

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• RentVise and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for lost profits, data loss, or business interruption
• Our total liability for any claim shall not exceed the fees you paid us in the 12 months preceding the claim
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

14. Indemnification

You agree to indemnify, defend, and hold harmless RentVise and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your data or content

15. Termination

By You: You may stop using the Service and delete your account at any time.

By Us: We may suspend or terminate your access to the Service at any time if:

• You violate these Terms
• Your use poses security, legal, or reputational risks
• Required by law or government order
• We discontinue the Service

Upon termination, your right to use the Service ends immediately. Provisions that should survive termination (e.g., disclaimers, limitations of liability) will remain in effect.

16. Governing Law and Disputes

• These Terms are governed by the laws of Kenya
• Any disputes shall be resolved in the courts of Kenya
• You agree to resolve disputes individually and waive the right to participate in class actions (where permitted by law)

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms with a new effective date
• Sending an in-app notification or email

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RentVise regarding the Service and supersede any prior agreements.
